The Attorney General serves as the chief legal officer of the State. The Attorney General is mandated by our constitution and elected to a four-year term by the people of Arizona.
The Attorney General's Office represents and provides legal advice to most State agencies; enforces consumer protection and civil rights laws; and prosecutes criminals charged with complex financial crimes and certain conspiracies involving illegal drugs. In addition, all appeals statewide from felony convictions are handed down by this Office.
The Child and Family Protection Division provides legal services to the Department of Economic Security (DES), including Child Protective Services (CPS) and Child Support Enforcement.
Consumer Protection Section Mission:
To protect the public from consumer fraud, antitrust and anti-competitive conduct. To provide advocacy and public education on consumer protection issues with an emphasis on fraud and abuse. To enforce tobacco laws and orders and to help reduce underage sale of tobacco products. To provide legal representation in judicial and administrative cases and legal advice and assistance in legislative and rule-making matter to state agencies.
Consumer fraud, as defined by Arizona law, is any deception, unfair act or practice, false statement, false pretense, false promise or misrepresentation made by a seller or advertiser of merchandise. In addition, concealment, suppression or failure to disclose a material fact may be consumer fraud if it is done with the intent that others rely on such concealment, suppression or nondisclosure. Merchandise may include any objects, wares, goods, commodities, intangibles, real estate or services.
The Arizona Attorney General has the authority to bring actions alleging violations of the Consumer Fraud Act and other state and federal consumer protection laws.A private citizen can also bring an action for a violation of the Consumer Fraud Act within one year from the date the claim arises.
